1. Purpose – Seller identification – Contact

1.1 Purpose
These General Terms and Conditions of Sale (hereinafter "GTC") govern the sale of products on the website www.mineral-pierre-naturelle.fr (hereinafter the "Site") to any consumer (hereinafter the "Customer").
They specify, in particular, the conditions for ordering, payment, delivery, right of withdrawal, and legal guarantees.

1.2 Seller
The Site is operated by Pierre de l’Est SAS, with a share capital of €100,000, whose registered office is located at 44 Rue de Nancy, 57915 Woustviller (France), registered with the RCS Sarreguemines B 794 310 672, trading under the name "Minéral Pierre Naturelle".
Intra-community VAT number: FR55794310672.

Unique REP Identifier
In accordance with articles L.541-10-13 and R.541-173 of the French Environmental Code, Pierre de l'Est SAS has the following unique identifier for the Household Packaging and Graphic Paper sector: FR331872_01WLAU.

1.4 Contractual documents
The GTC are available permanently on the Site. They can be consulted, downloaded and printed by the Customer. The Privacy Policy and Cookie Policy supplement these GTC for everything related to personal data.

 

2. Definitions

For the purposes of these General Terms and Conditions of Sale, the terms below shall have the following meaning:

  • "Customer": refers to any natural person of legal age acting as a consumer, i.e., for purposes not falling within the scope of their commercial, industrial, craft, or liberal activity, and placing an order on the Site.
  • "Order": refers to the purchase of Products made by the Customer on the Site according to the procedure described in article 6.
  • "Account": personal space created by the Customer on the Site, allowing them to enter their information, track their orders, and access their purchase history.
  • "Product(s)" or "Mineral Product(s)": refers to all products offered for sale on the Site under the brand Minéral Pierre Naturelle, including flagstones, wall facings, cobblestones, coping stones, tiles, and maintenance products.
  • "Supplier": refers to any partner or producer supplying Minéral Pierre Naturelle.
  • "Store": refers to any physical point of sale operated by the company Pierre de l’Est SAS under the brand Minéral Pierre Naturelle, whose updated list appears on the page: www.mineral-pierre-naturelle.fr/pages/nos-magasins.
  • "Site": refers to the website accessible at www.mineral-pierre-naturelle.fr.
  • "User": refers to any person browsing the Site, whether they are a simple visitor or a Customer.
  • "GTC": refers to these General Terms and Conditions of Sale, excluding the Professional GTC applicable to professionals.

 

3. Champ of application – Acceptance of the GTC – Online availability

These General Terms and Conditions of Sale (GTC) govern, without restriction or reservation, all sales concluded between Minéral Pierre Naturelle and any consumer Customer wishing to purchase one or more Products offered for sale on the Site www.mineral-pierre-naturelle.fr.
They specify, in particular, the conditions for ordering, payment, delivery, right of withdrawal, return, and the applicable legal guarantees.

The GTC, together with the order confirmation and the legal notices, constitute the entire contract concluded between Minéral Pierre Naturelle and the Customer.
Any contrary condition emanating from the Customer will be unenforceable against Minéral Pierre Naturelle, unless expressly accepted in writing by them.

3.2 Acceptance of the GTC
When placing an order, the Customer acknowledges having read and accepted these GTC without reservation by validating their order on the Site.
This validation constitutes express acceptance of the GTC in force at the time of the order, in accordance with Article 1127-2 of the Civil Code.
The order validation click constitutes an electronic signature and an irrevocable agreement on the content of the contract.

(Note: on the Shopify Site, the act of payment and order validation constitute full and complete acceptance of the GTC, even without a specific checkbox.)

3.3 Availability and enforceability of the GTC
The GTC can be consulted, downloaded or printed by the Customer at any time.
Minéral Pierre Naturelle reserves the right to modify these GTC at any time, without prior notice, but products will always be invoiced at the rate in force at the time of the order.
Any subsequent modification shall not apply to an already validated order.

 

4. Products & natural characteristics (natural stone: variations, samples, tolerances, installation recommendations)

4.1 Nature of the products

The products offered on the website www.mineral-pierre-naturelle.fr are natural materials: limestone, travertine, quartzite, slate, marble, sandstone, etc.
Each stone is unique. Consequently, natural variations in color, veining, structure, porosity, or texture are inherent to the material and do not constitute a defect under any circumstances.

Marble, marble stones, cut stones and all other rocks being natural materials, certain particularities such as wormholes, crystalline veins, flames, glass inclusions, geodes, shells, knots, "crapaud" spots, strata, rust spots or differences in shade cannot be considered defects, nor give rise to refusal or price reduction.

Any marble, marble stone or onyx is processed and consolidated according to the rules of art, with the masticing, doubling or staples that its nature and conformation require.
So-called "white" marbles may show speckles, clouds or gray veins, characteristic of the material.

For tiles, concrete products, colored or not, and reconstituted stones, color variations for the same color may occur during different productions. These nuances generally fade over time.

Minéral recommends that when installing, elements from different batches, packages or pallets should be mixed, even for grey products, to achieve a homogeneous appearance.
Under no circumstances can Minéral Pierre Naturelle be held responsible for these aesthetic variations, which are normal and inherent to the very nature of the materials.

4.2 Photographs and samples 

The photographs and samples presented on the Site or in store are strictly illustrative:
they define the general appearance of the material (dominant shade, texture, origin), but do not guarantee any perfect identity between the sample and the final supply.

4.3 Dimensional tolerances

Due to manufacturing processes and the specific characteristics of each rock, a tolerance on dimensions is considered compliant with NF B 10-601 standard.
For cleaved, split or rustic products (slates, schists, quartzites, wall facings), more significant variations in thickness and appearance are normal and are part of the desired natural finish.

4.4 Installation recommendations

  • It is imperative to mix elements from different pallets or boxes to achieve a harmonious finish. 
  • For paving stones, cobbles, and opus incertum, allow +10% additional surface area to compensate for cuts and waste.
  • For wall facings, allow +15% for installation with grout and +30% for dry-stack installation without grout.
  • Certain materials (especially travertine) may require localized re-grouting after several years: this is normal maintenance related to the porous nature of the material.

4.5 Product availability

The products offered on the Site are available within the limits of the indicated stock.
In the event of a product being unavailable after order validation, Minéral Pierre Naturelle will inform the Customer as soon as possible by email.
The order will then be automatically cancelled and refunded, unless otherwise agreed by the Customer for a replacement or an extended delivery time.

 

5. Prices – Taxes – Obvious errors (incl. VAT, currencies, eco-contribution, pricing errors)

5.1 Price display
All prices indicated on the Site www.mineral-pierre-naturelle.fr are expressed in euros (€) and include all taxes (TTC), including the Value Added Tax (VAT) at the rate in force in France on the day of the order.

The prices displayed do not include delivery costs, which are specified before the final validation of the order according to the transport method, destination, and total weight of the ordered products.

5.2 Price validity
The applicable prices are those displayed on the Site at the time of order validation.
Minéral Pierre Naturelle reserves the right to modify its prices at any time, without prior notice, but products will always be invoiced at the rate in force at the time of the order.

5.3 Promotions and commercial offers
Promotional offers, discounts or discount codes offered on the Site are valid for their indicated duration of validity and within the limits of available stock.
They are not cumulative with each other unless explicitly stated otherwise.

5.4 Obvious Error
In the event of an obvious pricing error (abnormally low price without objective justification), Minéral Pierre Naturelle reserves the right to cancel any order, even after automatic confirmation.
Such a situation may result from an input, update, or synchronization error.
The Customer will then be informed by e-mail and fully reimbursed for the amount already paid.

5.5 Invoicing
A detailed invoice is sent to the Customer by e-mail after the order has been validated.
It states the total amount including tax, the applicable VAT rate, and any delivery charges.

 

6. Order – Purchasing process – Confirmation

6.1 Ordering process
The Customer can place an order directly on the Website www.mineral-pierre-naturelle.fr according to the following process:

  1. Selection of products and adding them to the basket;
  2. Review of the basket summary before validation;
  3. Entry or verification of personal and delivery information;
  4. Choice of delivery method offered based on geographical area and total weight;
  5. Choice of payment method from the available solutions (CB, PayPal, Alma, etc.);
  6. Order validation and payment online via the secure page.

6.2 Final validation and formation of the contract
Before confirming the order, the Customer can correct or modify their basket, address, or delivery method.
The order is definitively registered only after payment validation.

The final validation entails:

  • complete and unreserved acceptance of these GTC,
  • acknowledgement of an obligation to pay,
  • formation of the sales contract between the Customer and Minéral Pierre Naturelle.

On the Shopify Site, payment validation constitutes express acceptance of the GTC.
The message displayed "By validating your order, you accept our General Terms and Conditions of Sale" meets this requirement.

6.3 Order confirmation
Once the order is validated, the Customer immediately receives a confirmation e-mail summarizing:

  • the description of the purchased products,
  • the total price paid (products + shipping),
  • the chosen delivery method,
  • and a link to the applicable GTC.

This e-mail confirms the order has been taken into account, but not yet its availability.
A second message is then sent as soon as the order is prepared or shipped.

6.4 Product availability
Products are offered within the limits of available stock displayed on the Site.
In case of unavailability of an item after validation, Minéral Pierre Naturelle will inform the Customer as soon as possible.
The Customer can then choose:

  • a full refund for the unavailable product, or
  • replacement with an equivalent product.

6.5 Refusal or cancellation by Minéral
Minéral Pierre Naturelle reserves the right to refuse or cancel any order in case of:

  • inability to debit payment,
  • suspicion of fraud or misuse of the site,
  • obvious error in price or product characteristics,
  • or ongoing dispute with the Customer regarding a previous order.

The Customer will then be informed without delay and reimbursed for any amount paid.

 

7. Payments (Credit Card, PayPal, Alma 4x interest-free and 12x with fees; security; refusal/cancellation if unsuccessful)

7.1 Accepted payment methods
Orders can only be paid for online, in euros (€), via the following payment solutions:

  • Credit card (Visa, Mastercard, American Express)
  • Apple Pay and Google Pay (fast payment without entering bank details)
  • PayPal
  • 4-times interest-free payment via Alma
  • 12-times payment via Alma (with fees)
  • Bank transfer (upon request only)

No order will be shipped before complete validation of the corresponding payment.

 

7.2 100% secure payment
All transactions are processed by Shopify Payments, PayPal, or Alma, depending on the chosen method, via encrypted connections compliant with SSL / PCI-DSS standards.
Card payments benefit from strong authentication (3D Secure).
Minéral Pierre Naturelle does not store any bank details and never has access to them.

7.3 4-times interest-free payment (Alma)
Thanks to our partner Alma, the Customer can pay for their order in 4 interest-free monthly instalments.

Main conditions:

  • Total order amount: from €50 to €4,000 including tax
  • Valid bank card (Visa, Mastercard, American Express)
  • Reserved for adult individuals residing in France or Germany

Choosing the 4-times payment automatically redirects to Alma's secure platform for validation of the request.
If accepted, the order is confirmed immediately and direct debits are made automatically according to the communicated schedule.

7.4 12-times payment (Alma)
For larger orders, the Customer can also benefit from 12-times payment via Alma (with fees).

The 12-times payment via Alma incurs fees specified before validation and is subject to Alma's approval (approved institution)

  • Eligible amount: from approximately €948 up to €4,000 including tax
  • The total cost of the credit and the payment schedule are indicated before validation
  • The application is subject to acceptance by Alma SAS, a payment institution approved by the ACPR (no. 90876)

7.5 Validation & invoicing
Payment validation makes the order firm and final.
In case of payment refusal or technical error, the order is automatically cancelled.
A detailed electronic invoice (amount including tax, VAT, delivery, payment method) is sent by e-mail to the Customer after confirmation.

 

8. Delivery & Collection

8.1 Delivery address

Minéral Pierre Naturelle delivers its products throughout mainland France (Corsica on quote) and in Germany.

If your delivery address has difficult access (high mountains, island, narrow passages or streets, one-way street, dead end, gravel in the reception area, etc.), we invite you to contact us beforehand to obtain a personalised quote. Failing this, additional costs may be charged to you.

8.2 Shipping methods

The delivery method is automatically determined based on weight, volume, and geographical area.
Minéral reserves the right to choose the most suitable carrier and logistics method without naming a commercial brand, in order to guarantee the best quality of service.

a) Small packages (up to 30 kg)

Delivery options:

  • to your home, or
  • to a relay point, when the Customer's address is eligible.

The choice is offered directly during the order process.

b) Light pallets (30 to 700 kg)

Delivery by truck equipped with a tail lift for ground-level drop-off.
Goods are delivered on a pallet, unpackaged, at the truck's tailgate or in an accessible and stable area.
An appointment can be made depending on the areas.

c) Heavy pallets and lots (700 kg to 24,000 kg)

Delivery by truck or semi-trailer with on-board forklift or equivalent equipment.
Products are dropped off at the closest safely accessible point, without installation or unloading within the property.
Beyond 24,000 kg, a specific quote will be provided.

8.3 Indicative lead times

  • Preparation: 2 to 5 working days for in-stock products.
  • Shipping: 3 to 15 working days depending on the area and mode of transport.
  • Delivery by appointment when arranged by the carrier.

Lead times are indicative and may vary depending on traffic conditions, weather, or activity periods.

8.4 Cancellation after dispatch
Once the order has been handed over to the carrier or entered the logistics circuit, free cancellation is no longer possible.
If the Customer nevertheless wishes to cancel their order after dispatch, this request will be processed under the right of withdrawal provided for in Article 10 below.
Return costs, repatriation costs, return to dock costs, re-delivery costs, or any other logistical costs actually charged by the carrier for the return of goods remain the responsibility of the Customer.

8.5 Access conditions

The Customer must ensure that the delivery location is accessible for a truck (12 to 40 tons) and comply with the following conditions:

  • clear and maneuverable access,
  • hard, flat, and stable ground (asphalt, concrete, or paving type),
  • absence of obstacles (slopes, low trees, obstructing vehicles, power lines, etc.).

If access is impossible, the carrier will drop off the goods at the closest safely accessible point.
If a second delivery is necessary due to non-compliant access or the Customer's absence, it may be re-invoiced.

Products are delivered on unpackaged pallets, placed on the ground by tailgate or forklift depending on the chosen method.
The carrier is not obliged to:

  • move pallets beyond the drop-off point,
  • deliver to a garage, garden, private property, or upstairs.

The Customer must provide the necessary equipment or labor for moving and storing the products after drop-off.

8.6 Receipt of goods

Upon delivery, the Customer must check the goods in the presence of the carrier.
Any visible anomaly (damaged pallet, broken product, missing or non-compliant item) must be noted on the delivery receipt, with precise and detailed reservations.
A vague mention such as "subject to unpacking" has no legal value.

The Customer has 48 working hours to report any problem to customer service:

8.7 In-store pickup

The Customer can, if they wish, collect their order free of charge from one of the 7 Minéral Pierre Naturelle stores.
An email notification is sent as soon as the order is ready.

  • Loading onto accessible flatbeds with a forklift is carried out by our teams.
  • For any other vehicle, pallets are dropped off nearby and loading remains the Customer's responsibility.

The Customer must arrive with a suitable vehicle and, if necessary, accompanied by someone for unloading.

8.8 Transfer of risks

Minéral Pierre Naturelle's responsibility remains engaged until the physical handover of the products to the Customer.
From this receipt, the risks of loss, theft or damage are transferred to the Customer, in accordance with Article L.216-4 of the Consumer Code.

9. Receipt – Non-compliance – Transport damage (useful reservations without forfeiture of rights; prompt notification recommended)

9.1 Verification upon receipt
Upon delivery, the Customer must check the condition and conformity of the products in the presence of the carrier.
Any visible anomaly (damaged pallet, broken product, missing or non-compliant item) must be noted on the delivery receipt, with a precise description of the nature of the damage.

Reservations must be:

  • detailed and circumstantial ("broken pallet corner - 2 broken tiles", "pierced pallet - missing package");
  • dated and signed;
  • confirmed to Minéral Pierre Naturelle within 48 working hours following delivery to the address:

A vague mention such as "subject to unpacking" has no legal value.

9.2 Products damaged during transport
In case of transport-related damage:

  • You must imperatively note on the delivery receipt: "Packaging and goods damaged".
  • Take clear photos of the package, packaging, and the affected product.
  • Contact Minéral Pierre Naturelle within 48 working hours via the form available on the Returns and Refunds page.

After verification, if the damage is confirmed, Minéral will fully bear the cost of replacing or refunding the products concerned, including return shipping fees.

9.3 Product not conforming to the order
If the Customer receives an incorrect item (wrong product, quantity, incorrect reference or finish):

  • The report must be made within 48 working hours following receipt;
  • Supporting photos must be attached;
  • After validation of the file, Minéral will offer replacement or refund.

The return shipping fees are then borne by Minéral.

10. Right of withdrawal (14 days)

10.1 Legal period
In accordance with articles L.221-18 et seq. of the Consumer Code, the Customer has a period of 14 calendar days from the day after delivery to notify their decision to return, without having to justify a reason.

This period is extended until the next working day if it expires on a Saturday, Sunday, or public holiday.

10.2 Withdrawal procedures

The Customer must unequivocally notify their decision to withdraw within the legal period, either via the return form available on the Website (Returns and Refunds), or by email to info@mineral-pierre-naturelle.fr.
Simply refusing delivery or voluntarily not receiving the goods does not, in itself, constitute a valid exercise of the right of withdrawal.
When the order has already been dispatched at the time of the withdrawal request, Minéral Pierre Naturelle can arrange, at the Customer's request, the return or repatriation of the goods with its partner carrier, or let the Customer appoint the carrier of their choice.

10.3 Eligibility conditions
Returned products must be:

  • in perfect condition, unused, uninstalled,
  • in their complete original packaging (pallets, protections, accessories, instructions, labels),
  • accompanied by the purchase invoice or order number.

Custom-made, manufactured, or specially ordered items are neither returned, exchanged, nor refunded.

10.4 Costs and reimbursement

Return costs are the responsibility of the Customer.
For heavy, bulky goods or goods shipped on pallets, these costs correspond to the actual cost of return transport, repatriation, or return to dock charged by the carrier, depending on the weight, volume, distance, access constraints, and stage of delivery of the order.
When the Customer requests the cancellation of an order already dispatched, the logistical return costs incurred for the repatriation of the goods remain their responsibility and may be deducted from the refund.
In accordance with applicable regulations, Minéral Pierre Naturelle will refund the amount of the returned products as well as the initial delivery costs at the standard rate, after receipt or proof of reshipment of the goods, subject to the returned products being in conformity.

The refund is made via the same payment method as that used for the order, unless otherwise agreed.

 

11. Returns – Logistics & reimbursement (packaging, pallet, appointment booking, refund period, refund method)

11.1 General return conditions
Returned products must be:

  • complete, uninstalled, undamaged, and in their original condition; Pallets must be “filmed and strapped

It is also possible to drop off products at one of the 7 Minéral stores, with prior agreement.

11.2 Return organization
Minéral can organize the return via a partner carrier, by appointment (Monday to Friday, between 8 am and 5 pm).
The Customer must ensure that:

  • the pallet is securely packaged,
  • the pickup area is flat, accessible and clear,
  • the products are loaded safely.

 

11.2.1 Cases of orders already in transit
When the Customer exercises their right of withdrawal while the order is already in transit or has arrived at the carrier's platform, Minéral Pierre Naturelle may request either a return to the dock, repatriation, or re-delivery, depending on the carrier's possibilities.
The corresponding costs, justified by a quote, price list, or carrier's invoice, remain the responsibility of the Customer and may be deducted from the refund.

11.3 Receipt Inspection
Each return is inspected upon arrival at our warehouses:

  • If the products are compliant, the refund is validated within 14 days.
  • If the products show damage or a condition preventing their resale, a discount or refusal of refund may be applied.

12. Legal Guarantees

12.1 Legal Guarantee of Conformity (articles L.217-3 to L.217-20 of the Consumer Code)
Minéral Pierre Naturelle is obliged to deliver goods that are in conformity with the contract and is liable for any defects in conformity existing at the time of delivery.

The goods are compliant if they correspond to the contractual description, possess the characteristics presented on the Website, and are fit for the use normally expected of a product of the same type.

The Customer has a period of two (2) years from the delivery of the goods to assert this guarantee.
No advance payment of fees can be required for the implementation of this guarantee.

In the event of a recognized defect in conformity:

  • Minéral Pierre Naturelle will proceed with product replacement, or, if impossible,
  • full refund of the amount paid, at no cost to the Customer.

Exclusions from the guarantee of conformity:
The following are not covered by this guarantee:

  • natural variations in shade, veining, texture, or structure inherent to natural stone (see article 4);
  • damage resulting from improper installation or unsuitable maintenance;
  • alterations due to normal use, impacts, or improper storage.

12.2 Legal Guarantee against Hidden Defects (articles 1641 to 1649 of the Civil Code)
Independently of the guarantee of conformity, the Customer may invoke the legal guarantee of hidden defects.
A hidden defect is a flaw that renders the product unfit for its intended use or reduces its value so much that the Customer would not have purchased it, or would have paid a lesser price, had they known about it.

The Customer has a period of two (2) years from the discovery of the defect to take action.
In the event of a recognized defect, Minéral Pierre Naturelle may, at the Customer's choice:

  • take back the goods and fully refund the price paid, or
  • partially refund the goods if the Customer wishes to keep them.

12.3 Specifics related to natural stone
Natural stones have physical and aesthetic characteristics that cannot be considered defects.
Therefore, the following do not constitute hidden defects:

  • shades of color or structure,
  • fossils, veins, shells, cavities,
  • marbling, rust spots, variations in texture or grain,
  • dimensional tolerances or minimal calibration differences in accordance with industry standards.

Minéral Pierre Naturelle commits to delivering products that comply with applicable technical standards and best practices in cutting and sorting.

14. Personal Data & Cookies (link to the dedicated Policy)

14.1 Data Collection and Use
As part of order management, Minéral Pierre Naturelle collects and processes certain personal data of the Customer (name, first name, address, telephone, email, payment information, purchase history).
This data is necessary for:

  • processing and delivery of orders,
  • invoicing,
  • customer service follow-up,
  • and, if the Customer consents, sending commercial offers or newsletters.

Processing is carried out in accordance with the General Data Protection Regulation (GDPR) – Regulation (EU) 2016/679.

14.2 Retention and Security
Personal data is kept for the period strictly necessary for the management of the commercial relationship and legal obligations (invoicing, warranty, dispute, etc.).
Minéral Pierre Naturelle implements all necessary technical and organizational measures to ensure the confidentiality and security of this information.
Payments are processed via certified providers (Shopify Payments, PayPal, Alma) in accordance with PCI-DSS standards, ensuring full encryption of banking data.

14.3 Customer Rights
In accordance with current regulations, the Customer has the following rights concerning their personal data at any time:

  • right of access, rectification, erasure,
  • right to object or restrict processing,
  • right to data portability,
  • right to withdraw consent at any time.

15. Force Majeure

15.1 Definition
Neither party shall be held responsible for any delay or failure to perform its contractual obligations if such delay or failure results from an event of force majeure, as defined by Article 1218 of the Civil Code.

Cases of force majeure include, but are not limited to:

  • natural disasters (floods, storms, fires, earthquakes);
  • blockages or interruptions of transport and communication routes;
  • total or partial strikes (internal or external);
  • computer failures or cyberattacks paralyzing the site or logistics;
  • war, riot, terrorist attack, epidemic, lockdown, administrative decision, or raw material shortage.

15.2 Effects of Force Majeure
Should such an event occur, the obligations of the hindered party shall be suspended for the duration of the force majeure event.
No penalties, compensation, or order cancellations may be demanded for this reason.

Minéral Pierre Naturelle undertakes to inform the Client as soon as possible of the occurrence of a force majeure event and to provide them with the new estimated date of delivery or performance.

Should the force majeure event last for more than thirty (30) days, either party would have the right to cancel the order in writing, without compensation, and any sums paid by the Client would then be refunded.

 

16. Intellectual Property (texts, photos, plans, diagrams)

16.1 Website Content
All elements appearing on the website www.mineral-pierre-naturelle.fr — including texts, photographs, visuals, logos, graphics, videos, product sheets, diagrams, plans, editorial content, as well as the architecture and layout of the Site — are the exclusive property of Pierre de l’Est SAS / Minéral Pierre Naturelle, or are subject to specific authorization for use.

Any reproduction, representation, dissemination, modification or exploitation, in whole or in part, of these elements, by any means whatsoever, without prior written authorization from Minéral Pierre Naturelle, is strictly prohibited and would constitute an infringement punishable by articles L.335-2 et seq. of the Intellectual Property Code.

16.2 Trademarks and Names
The trademarks “Minéral Pierre Naturelle”, “Pierre de l’Est”, as well as their logotypes and visual variations, are registered trademarks and protected as such.
Any unauthorized reproduction, imitation or use is strictly prohibited.

16.3 Use of Content by the Client
The Client does not hold any intellectual property rights over the elements of the Website.
Any use of visuals, texts or photographs for commercial, advertising or competitive purposes is expressly prohibited without the written consent of Minéral Pierre Naturelle.

17. Applicable Law – Competent Courts (consumer)

17.1 Applicable Law
These General Terms and Conditions of Sale, as well as all purchase and sale operations carried out via the website www.mineral-pierre-naturelle.fr, are governed by French law.
This legislation applies to both substantive and procedural rules, regardless of the Client's nationality or the place of delivery.

In the event of a sale to a Client domiciled in another European Union country (notably Germany), the mandatory consumer protection provisions provided for by the legislation of the Client's country of residence remain applicable.

17.2 Dispute Resolution
In the event of a disagreement or dispute relating to an order placed on the Site, the parties will endeavor to find an amicable solution within a reasonable time.
Failing agreement, the dispute will be brought:

  • before the competent French courts if the Client is a consumer residing in France,
  • or before the competent courts of the country of residence of the European Client in accordance with Regulation (EU) No 1215/2012 (Brussels I recast).

The Client may also resort, without obligation, to the mediation procedure or to the European Online Dispute Resolution (ODR) platform mentioned in article 13.

17.3 Language of the Contract
These General Terms and Conditions of Sale are drafted in French, the only authoritative version in case of interpretation or dispute.

 

18. Updates to the GTC – Applicable Version

  • Minéral Pierre Naturelle reserves the right to modify or update these General Terms and Conditions of Sale at any time, particularly to comply with any legal, regulatory, technical or commercial developments.
  • The applicable version for each order is the one in force at the time of payment validation.

Any new version will be indicated by an update date appearing at the top of the page.

The Client is invited to consult this page regularly to be aware of any modifications.
By continuing to use the Site after the publication of a new version, the Client is deemed to have accepted the revised conditions.
